Terms of Service

1. Agreement and operator

These Terms of Service govern your access to and use of Cobalt Cat, a food, nutrition, and body-weight tracking service operated by Viktor Livar.

By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service. Questions can be sent to support@cobaltcat.app.

2. The service

Cobalt Cat provides tools that may allow you to:

• record food products, portion sizes, meal times, and daily intake;
• calculate and review calories and macronutrients;
• record actual and target body weight;
• create and edit custom products and product images;
• organize products with favorites, ordering, labels, and settings;
• review historical summaries and progress charts; and
• store data locally and synchronize eligible data when signed in.

Available features may change as described in these Terms.

3. Eligibility

You must be at least 16 years old and legally capable of entering into these Terms. If applicable law requires parent or guardian involvement despite that age, you may use the service only with that involvement and authorization.

4. Accounts and authentication

Some functionality requires an account. You agree to provide accurate account information, protect your device and credentials, not permit unauthorized account use, and notify us if you discover unauthorized access.

You may authenticate with credentials managed by Amazon Cognito or, where offered, through Google. Your use of Google sign-in is also subject to Google terms and policies. You are responsible for activity through your account except to the extent applicable law provides otherwise.

5. Not medical or nutritional advice

Cobalt Cat is a personal tracking and informational tool. It does not provide medical, nutritional, diagnostic, treatment, or other professional healthcare advice.

Calories, macronutrients, classifications, summaries, targets, and trends must not be treated as a diagnosis, treatment recommendation, or substitute for advice from a qualified professional. Food composition varies, and calculations may be incomplete, estimated, outdated, or incorrect.

You remain responsible for decisions concerning your diet, weight, health, and wellbeing. If you have a medical condition, dietary restriction, eating disorder, pregnancy, medication concern, or other health issue, consult an appropriate healthcare professional before making significant changes. Cobalt Cat is not designed for medical emergencies.

6. Your data and content

You retain your rights in information and content that you submit, including intake records, body-weight records, custom products, labels, settings, and images.

You grant the operator a limited, non-exclusive right to host, copy, resize, convert, transmit, synchronize, back up, and otherwise process that content only as necessary to provide, secure, maintain, and support the service and comply with law. This permission ends when the content is deleted, except where temporary technical retention or legal obligations apply.

You are responsible for the accuracy and lawfulness of content you submit and for ensuring that you have the rights and permissions needed to use it.

7. Product images and external image URLs

You may upload, paste, or ask Cobalt Cat to import an image from a public URL. You must not submit unlawful content, private documents, sensitive personal information, images of people without appropriate permission, or material that infringes copyright or other rights.

Product images are stored at publicly accessible object URLs. They are not intentionally published as a user gallery, but anyone who obtains an image URL may be able to view it. Only use images that are suitable for that level of accessibility.

When you supply an external image URL, you represent that the service is permitted to retrieve and process the image. External sites remain governed by their own terms and may change or block access without notice.

8. Nutrition and product information

Product and nutrition information may originate from platform datasets, user-created products, historical records, or calculations. We do not guarantee that product names, images, portion measurements, calories, macronutrients, or classifications are complete or accurate.

Nutrition can vary by brand, recipe, preparation method, storage, and measurement. You should independently verify information whenever accuracy is important, particularly for allergies, medical conditions, or clinical decisions.

9. Local-first storage, synchronization, and data loss

Cobalt Cat stores application data in your browser and synchronizes eligible data with the backend when you are signed in. Guest data is local to the browser unless you later sign in. Clearing browser data or losing a device can permanently remove information that has not synchronized.

Synchronization can be delayed, interrupted, or affected by network, device, browser, authentication, or service errors. No storage system can guarantee that data will never be lost, corrupted, duplicated, or unavailable. You should retain independent records of information that is critical to you.

10. Acceptable use

You must not:

• violate applicable law or another person’s rights;
• gain or attempt to gain unauthorized access to accounts, systems, or data;
• interfere with, disrupt, damage, reverse engineer, or bypass security or access controls except where applicable law expressly permits it;
• introduce malware, harmful code, or deceptive content;
• intentionally overload, scrape, or automate access in a way that materially interferes with normal operation;
• impersonate another person or misrepresent your authorization; or
• use the service to upload or distribute unlawful, infringing, or harmful material.

We may take reasonable technical or account-level action to prevent abuse, protect users and infrastructure, investigate security incidents, or comply with law.

11. Cobalt Cat intellectual property

Except for user-provided or third-party content, Cobalt Cat software, interfaces, design, branding, and original materials are owned by or licensed to the operator and protected by applicable intellectual-property law.

These Terms give you a personal, limited, non-exclusive, non-transferable, and revocable permission to use the service for its intended purpose. They do not transfer ownership of the service or its intellectual property.

12. Third-party services

The service depends on third parties, including Amazon Web Services and, when you select Google sign-in, Google. Third-party services may be unavailable, change, or operate under their own terms and privacy policies.

Cobalt Cat may link to independent websites or retrieve user-requested images from external URLs. We do not control or endorse independent third-party content, services, availability, or practices.

13. Availability and changes

We aim to keep Cobalt Cat useful and reliable, but do not guarantee uninterrupted, timely, secure, or error-free availability. Maintenance, updates, infrastructure failures, security incidents, third-party failures, and events outside reasonable control can interrupt the service.

We may add, remove, modify, suspend, or discontinue features or the service. Where applicable law requires notice of a material adverse change or discontinuation, we will provide reasonable notice when practicable.

14. Suspension, termination, and deletion

You may stop using Cobalt Cat at any time. Account deletion is currently available by request at the support address identified below rather than through an in-app control.

We may restrict or terminate access when reasonably necessary because you materially violate these Terms, your use creates a security or legal risk, an account is used fraudulently or unlawfully, we are legally required to act, or continuing the service is no longer reasonably possible. We will provide notice where appropriate and legally required.

Account deletion is permanent once completed. Server-side deletion does not automatically erase local browser storage on your devices.

15. Disclaimer of warranties

To the extent permitted by applicable law, Cobalt Cat is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, completely secure, or suitable for every purpose, or that nutrition and product information will be complete or accurate.

Nothing in these Terms excludes statutory warranties, guarantees, or consumer rights that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, special, consequential, or similar losses arising from use of or inability to use the service, reliance on nutrition or tracking information, loss of unsynchronized local data, or third-party services.

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful, including mandatory liability for fraud, intentional misconduct, gross negligence, death or personal injury where applicable, or non-waivable consumer rights.

17. Privacy

The Privacy Policy explains how Cobalt Cat processes personal data, including local storage, synchronized nutrition and body-weight data, authentication, service providers, retention, and your rights. It forms part of the information governing your use of the service and is linked below.

18. Changes to these Terms

We may update these Terms when the service, legal requirements, or operating practices change. We will update the effective date and provide additional notice where required for a material change.

Continued use after updated Terms take effect constitutes acceptance where permitted by law. If applicable law requires explicit acceptance, we will request it.

19. Governing law and consumer rights

These Terms are governed by applicable law, without depriving consumers of mandatory protections provided by the law of the country where they habitually reside.

Disputes are subject to the courts that have jurisdiction under applicable law. If you are a consumer, nothing in these Terms limits any right to bring proceedings in a court available to you under mandatory consumer-protection rules.

20. General terms

These Terms and the Privacy Policy form the agreement concerning your use of Cobalt Cat, except for additional terms expressly presented for a specific feature. If a provision is invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.

A failure to enforce a provision is not a waiver of the right to enforce it later. You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits otherwise.
